Saving a transport company with 12 cars before auction

Mr. Marek had been running his transport business for 8 years. In May 2024, he faced the specter of losing 3 key tractor-trailers because the bank stopped believing in assurances of repayment. Wisła Restructuring House entered the game when only 11 business days remained until the auction.

The challenge

Trans-Marek Logistyka fell into a spiral due to payment bottlenecks from two large contractors who were late with invoices for 183,400 PLN. The lack of this cash meant Mr. Marek stopped paying installments for 3 new cars on lease. The bank terminated the 115,000 PLN account limit agreement and demanded immediate full repayment. Total overdue debt was 412,300 PLN. Daily calls from debt collectors paralyzed the dispatchers' work, and drivers began to gossip about bankruptcy.

Our approach

We started with a hard audit of finances at the client's office near Warsaw. For 3 days, we analyzed every bank statement and every agreement. Our team, led by the operations director, prepared a realistic cash flow plan that showed banks that the company is still earning, just having a problem with payment timeliness. We personally contacted the bank's restructuring department, presenting specific evidence that the client's contractors had already begun to pay back the overdue 183,400 PLN in weekly installments.

The solution

We halted the auction process by formally opening negotiations for an out-of-court settlement. Instead of a court fight, we proposed an arrangement to the bank: 4 months of so-called loan holidays on principal installments, while paying interest only. The terminated account limit was successfully converted into an installment loan spread over 36 months. Thanks to this, the requirement for immediate repayment of 115,000 PLN disappeared, giving the company the necessary oxygen for current activities.

Results

Trans-Marek Logistyka avoided auction and still operates with a full fleet of 12 vehicles. Relations with the bank were repaired, and Mr. Marek regained control over the payment calendar.
